GPA is a wrong filter for PhD. It should be the evaluation of research potential by a supervisor, not GPA. I know of a person who has 2.8 CGPA at Bachelors level and he has been accepted to a PhD program to University of California, Los Angeles. I don't think HEC should mandate GPA for a research degree. A 2 GPA holder can have very good research skills for a specific subject of his liking which GPA can never tell!

If the Supervisor is OK to take the student and University is OK to take the student even if he/she has CGPA<3.0 than HEC should have no objection. Admission of a student is at strictly University's discretion. HEC should focus on specifying the quality criterion of the research produced and ask the Universities to implement those criterion. What's wrong with that?

As far as HEC is concerned I thing some rules regarding PhD need to be revised, primary focus or you can say all attention should be on research instead of Course work then comprehensive. 18 years of education are enough for course work. As for as admission is concerned every one who got 18 years of education should be given chance to compete for PhD.

Yes, its totally unfair. If a HEC recognised institute issues MS degree, then its right of the student to take admission in PhD.
